邻避冲突的协商治理研究
——基于杭州中泰垃圾焚烧厂选址案例的分析
摘 要
随着城市化的快速发展和居民生活水平的提高，政府不断进行公共设施建设，增加民生福祉。在邻避设施项目带来效益的同时，它也产生了一定的负外部性，影响着周围居民的生活。再加上政府传统治理理念的影响，公众参与度不高。因此，本文将从协商民主理念的角度出发，探索邻避冲突的治理。
本文将根据目前我国的邻避冲突问题，首先,阐述研究背景、国内外的研究现状，说明整个课题研究的具体思路、内容等，并将通过文献法、案例法和规范分析法对其展开研究。其次，对邻避冲突和协商治理的基本概念进行明确，提出研究会运用的基本理论，包括社会冲突理论、协商民主理论、善治理论等。接着，引入一个我国邻避冲突的典型案例。通过对杭州中泰垃圾焚烧厂选址案例的深度分析，并结合我国实际，指出在我国邻避冲突协商治理过程中，存在政府公信力不足、公众思想意识淡薄、协商程序不健全等问题。结合我国的国情，进一步分析这些问题的原因，发现协商环境混乱、协商主体能力意识缺乏以及协商治理制度不完善，都影响着邻避冲突的协商治理。最后，针对邻避冲突协商治理实践的困境和原因，提出可以构建协商治理环境、培育公众协商意识、完善协商治理配套制度，来推动邻避冲突协商治理的发展。
STUDY ON THE NEGOTIATION MANAGEMENT OF NIMBY CONFLICT
—— BASED ON THE ANALYSIS OF THE SITE SELECTION CASE OF ZHONGTAI WASTE INCINERATION PLANT IN HANGZHOU
ABSTRACT
With the rapid development of urbanization and the improvement of residents living standards,the government has been continuously building public facilities to improve peoples wellbeing.While the NIMBY project brings benefits,it also generates negative externality, affecting the life of the surrounding residents.Coupled with the influence of the governments traditional governance philosophy,public participation is not high.Therefore,this paper will explore the governance of NIMBY conflict from the perspective of consultative democracy.
Based on the current NIMBY conflict in China,first,this paper will elaborate the research background,the research status at home and abroad,explain the specific ideas,contents of the whole research,and carry out the research through the literature method,case method and the standard analysis method.Secondly,the basic concepts of NIMBY conflict and consultative governance are clarified,and the basic theories applied in the study are put forward,including social conflict theory,consultative democracy theory and good governance theory.Then,a typical case of nimby conflict is introduced.Based on the indepth analysis of the site selection case of zhongtai waste incineration plant in hangzhou and the actual situation in China,this paper points out that in the process of NIMBY conflict negotiation and governance in China,there are some problems such as insufficient government credibility,weak public consciousness and unsound negotiation procedures.Based on Chinas national conditions,this paper further analyzes the causes of these problems,and finds that the confusion of negotiation environment,the lack of negotiation subjects ability consciousness and the imperfect negotiation governance system all affect the negotiation governance of NIMBY conflict.Finally,in view of the difficulties and causes of the practice of NIMBY conflict negotiation governance,it is suggested that the development of NIMBY conflict negotiation governance can be promoted by constructing a consultative governance environment,cultivating the publics awareness of consultation,and improving the supporting system of consultation governance.
