秦皇岛市马圈子镇农村宅基地退出问题及对策研究
摘 要
近年来，城市建设用地供给紧缺和农村闲置宅基地增长的矛盾日益突出，虽然我国的宅基地制度是随着社会发展而不断变迁的，但从宅基地无偿永久使用可以看出宅基地制度带有明显的福利性和身份性。虽然，在一定程度上为农民带来了福利和生活保障，为社会安定发挥了积极作用，但随着经济的发展和时代的变迁，这种在计划经济时期建立的宅基地制度已经明显显现出了严重的滞后性，已经不再能满足农民的生活需要。而且，由于法律法规禁止宅基地进入市场自由交易造成了两个严重后果，其一，由于无法自由退出，农村宅基地大量闲置，农村村庄占地不断增加，但村庄人口却出现不断减少的现象；其二，由于国家限制宅基地流转，便产生了活跃的宅基地私下不合法交易市场，为宅基地的规范管理带来了难度。秦皇岛市在2008年开展的新民居政策即为对宅基地退出制度的探索模式，但在实践过程中出现了很多问题导致项目效果并不理想，一些建成的项目农民参与度不高，还有一些项目在建设中期就已叫停。本文将对地区实践的宅基地退出模式进行梳理，并根据河北省秦皇岛市马圈子镇的实际情况，探讨宅基地使用过程中的现实性问题并为完善秦皇岛市马圈子镇宅基地退出制度提出相关政策意见。

Although the homestead system in China is constantly changing with the development of society, it can be seen from the free permanent use that the homestead system has obvious welfare and identity. To some extent, it has brought welfare and life security to farmers and played a positive role in social stability, but with the development of economy and the changes of the times, the homestead system established in the planned economy period has obviously shown a serious lag, and can no longer meet the needs of farmers. Moreover, there are two serious consequences caused by laws and regulations prohibiting homestead from entering the market for free trade. First, a large number of rural homestead are idle due to the lack of free exit. Rural villages occupy more land, but their population keeps decreasing. Secondly, due to the states restrictions on the transfer of homestead, there is an active illegal transaction of homestead, which brings difficulties to the standard management of homestead. In Qinhuangdao city, the new residential policy launched in 2008 was an exploration mode of the homestead withdrawal system. However, many problems occurred in the practice process, resulting in unsatisfactory project results. Some completed projects had low participation of farmers, and some projects were suspended in the middle of construction. This paper will sort out the withdrawal mode of homestead in practice in the region, and according to the actual situation of Majuanzi town, Qinhuangdao city. This paper will discuss the practical problems in the use of homestead and put forward relevant policy opinions for improving the homestead withdrawal system in Majuanzi town, Qinhuangdao city.
