现宅基地的农村人口居住保障功能与土地资产化的流转及收益功能之间的动态平衡,推动宅基地流转,以释放农村宅基地中巨大的经济潜力,贴合快速发展的社会需要。具体流转实践需要经过政策意图和物权法理的提炼和检验,应从试点地区改革措施出发,剖析宅基地流转中的“三权分置”权利结构和权能性质,并从法律视角对实践做法的合理性加以甄别,以确立宅基地对外流转的权利构造和运行规则。通过分析宅基地“三权分置”改革的地方规范性文件,可以发现当前改革存在所有权主体虚置、资格权和使用权的权利性质不明确以及资格权与使用权分置路径不清晰的问题,“三权分置”的权利结构不合法理。相对应的制度设计包括对集体经济组织赋权,从而落实集体土地所有权;将宅基地资格权的权利性质定义为优先受让权,充分发挥资格权对农户的保障功能;构建社会主体取得宅基地的权利属性为集体经营型建设用地使用权,使宅基地流转最终表现为“所有权+资格权+不动产用益物权”的权利分置形态。

STUDY ON THE RIGHT FRAMEWORK OF THREE RIGHTS SEPARATION IN THE TRANSFER OF RURAL HOMESTEAD
ABSTRACT
The reform of the "separation of three rights" in homestead is aimed at keeping the balance between the ability to protect rural people living under their roofs and the ability to get profit or capitalize rural lands. The government promote the homestead’s transferring so as to release the tremendous financial potential in those homesteads. The concrete transferring practice should be extracted and tested by policy intention and property law. In order to do this, we should begin with the practical measures, analyzing the right framework and running rules, then examine the rationality of practice from the perspective of law. Some problems existed in the local normative documents for the "separation of three rights" in homestead, such as the the connotation and nature of the qualification right and the right to use, and the unclear separation path of the qualification right and the right to use. The circulation logic of "separation of three rights" is not in accordance with legal principle. The legislation of rural homestead transfer needs to strengthen farmers’ collective land ownership by give them rights, definite qualification right as the priority transfer right to protect farmers’ rights, and establish social subjects’ right to use homestead in the perspective of the right to manage collective construction land, thus making the three right of rural homestead transfer as the form of “ownership+qualification right+ homestead use right”.
